New Vets100 Reporting Category for Veterans


The Veterans Employment Opportunities Act of 1998 (Public Law 105-339) has created an additional category of veterans called "Other Eligible Veterans." Prior to this law, there had been two groups of veterans - Special Disabled Veterans and Veterans of the Vietnam Era. Now the affirmative action obligations of federal contractors and subcontractors regarding veterans, and the VETS-100 reporting requirement, applies to all three groups of veterans. The inclusion of the "Other Eligible Veterans" group is optional for this year's VETS-100 Report (due on September 30, 1999) but will be required for next year's (2000) VETS-100 Report.

The general category of Other Eligible Veterans includes two key veteran groups. First, it includes veterans who served in a "war." Since the last declaration of war issued by Congress initiated World War II, veterans with active duty service between December 7, 1941 and April 28, 1952 are considered veterans of World War II and are included in the Other Eligible Veterans category. The second veteran group in the Other Eligible Veterans category includes those veterans who served in a campaign or on an expedition for which a campaign badge, a service medal, or an expeditionary medal has been awarded. The definition of all three categories appears below:

SPECIAL DISABLED VETERAN

  1. A veteran who is entitled to compensation (or who but for the receipt of military retired pay would be entitled to compensation) under laws administered by the Veterans Administration for a disability that is:
    1. Rated at 30 percent or more; or
    2. Rated at 10 to 20 percent in the case of a veteran who has been determined to have a serious employment handicap; or
  2. A person who was discharged or released from active duty because of a service connected disability.

VETERAN OF THE VIETNAM ERA

  1. A person who served on active duty for a period of more than 180 days, and was discharged or released therefrom with other than a dishonorable discharge, if any part of such active duty occurred: (i) in the Republic Vietnam between February 28, 1961,and May 7, 1975; or (ii) between August 5, 1964 and May 7, 1975, in all other cases; or
  2. A person who was discharged or released from active duty for a service-connected disability if any part of such active duty was performed (i) In the Republic of Vietnam between February 28, 1961, and May 7, 1975; or (ii) between August 5, 1964, and May 7, 1975, in all other cases.

OTHER VETERAN

A veteran who served on active duty during a war or in a campaign or expedition for which a campaign badge has been authorized.
